Your privacy is important to the Canadian Black Nurses Alliance (CBNA) and to better protect your privacy, we provide this notice explaining our online information practices. This Privacy Policy explains how we collect, use and (under certain conditions) disclose your personal information as well as the steps we have taken to secure your personal information. In addition, this Privacy Policy explains your options regarding the collection, use and disclosure of your personal information. By visiting the Site directly or through another site, you accept the practices described in this Policy.
This privacy policy applies to the Site. This privacy policy does not necessarily apply to any offline collection of your personal information. Please see below for details.

CBNA is not responsible for the content or privacy practices on any website not operated by CBNA to which the Site links or that links to the Site.

COLLECTION AND USE OF INFORMATION

We collect information from you in several different ways on this Site. Our goal in collecting personal information from you is to provide an efficient, meaningful, and customized experience. For example, we can use your personal information to:
• Help make the Site easier for you to use by not having to enter information more than once.
• Help you quickly find information, products, and services.
• Help us create content that is most relevant to you.
• Alert you to new information and products, promotions and services that we offer.

(a) Membership and Ordering. Before using certain parts of any Site or ordering products, you must complete an online registration form. During registration, you will be prompted to provide to us certain personal information, including but not limited to your name, shipping and billing address( es), phone number, email address, and credit card number. In addition, we may also ask you for your country of residence and/or your organization’s country of operation, so we can comply with applicable laws and regulations. This kind of personal information is used for billing purposes, to fulfill your orders, to communicate with you about your order and the Sites, and for internal marketing purposes. If we encounter a problem when processing your order, your personal information may be used to contact you.

(b) Email Addresses. Several locations of the Site permit you to enter your email address for purposes including but not limited to: registering for a contest or sweepstakes; to request alerts that will notify you of new brands, new product styles, or other new products; or to sign up for email newsletters and special offers. Your participation in a contest or sweepstakes is completely voluntary, so you have a choice whether to participate and disclose information to us. We use this information to notify contest and sweepstakes winners and to award prizes. We may post on the Site the names, cities and states, photos and/or videos of contest and sweepstakes winners. By entering a contest or sweepstakes, you may be opting in to receive our email newsletter and special offers and this will be disclosed in the official rules governing the contest or sweepstakes.

Occasionally www.canadianblacknursesalliance.org may be required by law enforcement or judicial authorities to provide Personally Identifiable Information to the appropriate governmental authorities. The contents of the CBNA Sites, such as text, graphics, images, information obtained from CBNA licensors and other material (“Content”) contained on the CBNA Sites are for informational purposes only.

Please read this information carefully as it contains important details about the organization terms & conditions that may apply to you.

COPYRIGHTS AND OTHER RIGHTS
The Content is protected by copyright under both Canadian and foreign laws. Title to the Content remains with CNA or its licensors. Images of the CBNA logo, people or places displayed on the CBNA site are either the property of, or used with permission by, CBNA use of these images by you or other third parties is prohibited unless expressly permitted in the Terms of Use or elsewhere on the CBNA site. Any unauthorized use of these images may violate copyright laws, trademark laws, the laws of privacy and publicity, and other applicable regulations and statutes. Any product, service, program or technology described in any document published by CBNA on this site may be the subject of other intellectual property rights owned by CBNA. Any such right that is not expressly licensed hereunder is reserved by CBNA.

If you violate any of these Terms and Conditions, your permission to use the Content automatically terminates and you must immediately destroy any copies of Content you have made.

Use by For-Profit Companies and Commercial Uses of Content.
If you are a for-profit company (including, without limitation, publishers) or an individual intending on selling a work that incorporates Content or an item thereof, subject to your compliance with these Terms, the Conditions of Use, and the payment of the Royalty Fee, CBNA hereby grants you a one time only, limited, non-exclusive, non-transferable, non-assignable, and revocable license, without the right to grant sublicenses to others, to copy and reproduce an item or items of Content only upon the following conditions:

(1) You must submit the Permission to Redistribute Form which must be completed for each request and for each item of Content you wish to copy or reproduce, separately. Request a form from infocbna@gmail.com

(2) For each copy or reproduction of a CBNA Publication in whole or in art, you agree to pay to CBNA in advance of making any such copy or reproduction Royalty Fee equal to C$250.00 for each language that you wish to publish;

(3) For any copy or reproduction of Content that represents a small amount or brief passage, such as, for example, a single table, figure or paragraph of a CBNA Publication or Content, you agree to pay to CBNA in advance of any making any such copy or reproduction, a Royalty Fee equal to C$115.00 for each language that you wish to publish;

(4) In addition to a license to copy and reproduce an item or items of Content, you require a license to translate into a language other than English or French, a small amount or brief passage such as, for example, a single table, figure or paragraph of a CNA Publication or Content, you agree to pay to CNA in advance of making any such translation (at your expense), an additional Royalty Fee equal of C$200 per item translated. You must provide the translated item for approval to CNA in advance of its use or publication. If, you do not receive a response from CNA within ten (10) business days from the date the translated item is provided to CNA for verification and approval, CNA shall be deemed to have verified and approved the translated item; and

(5) any copy or reproduction made of Content or item of Content (including any translated item) must be made within the ten-year period following the execution of the Permission to Redistribute Form.

Use by Non-Profit Entities and Nursing Schools
If you are a Non-Profit organization or a Nursing School, subject to your compliance with these Terms and with the Conditions of Use (noted below), CBNA hereby grants you a limited, non-exclusive, royalty-free, non-transferable, non-assignable, and revocable license, without the right to grant sublicenses to others, to copy and reproduce an item or items of Content.

Use by Individuals for Non-Commercial Purposes and Students
If you are a student or an individual intending to incorporate Content in a work that will not be sold, subject to your compliance with these Terms, and with the Conditions of Use (noted below), CBNA hereby grants you a limited, non-exclusive, non-transferable, non-assignable, and revocable license, without the right to grant sublicenses to others, to copy and reproduce an item or items of Content.

Conditions of Use
All licenses granted under these Terms shall be subject to the following Conditions of Use:

You must include the following notice: “© [INSERT CURRENT YEAR] Canadian Black Nurses Alliance. Reproduced with permission. Further reproduction is prohibited.”
You may not modify, alter, or otherwise amend any Content or item of Content without the prior written approval of CBNA, for which consent may be withheld for any reason and at CBNA’s absolute discretion.

TRADEMARKS
CBNA does not accept liability beyond the remedies set forth herein, including any liability for products, or events not being available for, or the provision of services and support. CBNA will not be liable for consequential, special, indirect or punitive damages even if advised of the possibility of such damages, or for any claim by any third party except as expressly provided herein. This limitation of liability applies both to products and services. Member, Partner, and Customer agree that for any liability related to the purchase of product CBNA is not liable or responsible for any amount of damages above the aggregate dollar amount paid by the customer for the purchase of products under this agreement. Customer agrees that for any liability related to the purchase of services not bundled with products under this agreement, CBNA is not liable or responsible for any amount of damages above the aggregate dollar amount paid by the customer for the purchase of services under this agreement.

SUBMISSIONS
With the exception of your personal information, any communication or material you send to the CBNA site, electronically or otherwise, including but not limited to data, questions, comments, suggestions, or submissions is and will be treated as non-confidential and non-proprietary. Anything you send to CBNA may be used by CBNA for any purpose including but not limited to modification, reproduction, transmission, disclosure, publication, broadcast, and posting. By submitting material to CBNA you irrevocably transfer and assign to CBNA and forever waive and agree never to assert, any copyrights, “moral” rights, rights of publicity or to privacy, or other intellectual property or proprietary rights that you may have in such material. CBNA is free to use, without obligation of any kind, any ideas, concepts, techniques, or know-how contained in any communication you send to the CBNA site for any purpose whatsoever, including but not limited to developing manufacturing, and marketing products and services.

Advertisements and Links to Other Sites
CBNA does not endorse the content on any third-party websites. CBNA is not responsible for the content of linked third-party sites, sites framed within the CBNA Sites, or third-party advertisements, and does not make any representations regarding their content or accuracy. Your use of third-party websites is at your own risk and subject to the terms and conditions of use for such sites. CBNA does not endorse any product advertised on the CBNA Sites.

Indemnity
You agree to defend, indemnify and hold CBNA its officers, directors, employees, agents, licensors and suppliers, harmless from and against any claims, actions or demands, liabilities and settlements including without limitation, reasonable legal and accounting fees, resulting from or alleged to result from, your violation of these Terms and Conditions.

Jurisdiction
You expressly agree that exclusive jurisdiction for any dispute with CBNA, or in any way relating to your use of the CBNA Sites, resides in the courts of the province of Ontario and you further agree and expressly consent to the exercise of personal jurisdiction in the courts of the province of Ontario in connection with any such dispute including any claim involving CBNA, its affiliates, subsidiaries, employees, contractors, officers, directors, telecommunication providers and content providers.

These Terms and Conditions are governed by the laws of the province of Ontario and the laws of Canada applicable thereto, without respect to conflict of laws principles. If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect. No waiver of any of these Terms and Conditions shall be effective unless in writing and, signed by an authorized signing officer of CBNA and no such waiver shall be deemed a further or continuing waiver of such term or condition or any other term or condition.

RETURNS, EXCHANGES & CANCELLATIONS
CBNA DOES NOT OFFER REFUNDS.
ANY RETURNS OR CANCELLATIONS WILL RECEIVE STORE CREDIT.

CBNA wants you to be fully satisfied with your purchase. If an item does not fit or simply did not work out, you may return it within 7 days of the date it was delivered. Any items returned after 7 days from the date it was delivered will be returned back at the buyer’s expense. Store credit codes are issued for the amount spent on your item(s). Please keep in mind store credit codes cannot be combined with any other discount codes. Store credit codes are good for one year and do not cover shipping costs. Once your return parcel is received, please allow 72 hours of processing time for our team to send your store credit code via email. Your return must be unused and in all original packaging. We will not accept returned merchandise that appears worn, damaged, or dirty. Please ship your return merchandise using a shipping method that you can track. We do not take responsibility for packages we did not ship.

PAYMENT TERMS
All terms of payment are always 100% upfront. We accept all major credit cards. As soon as you place an order online your credit card will be charged. We have zero-tolerance for Credit card fraud and theft of our merchandise. Any fraudulent purchases will be prosecuted to the fullest extent of the law. If your billing address is different from your shipping address you will be required to fill out a credit card authorization form and send documentation before your shipment is released. If this is necessary a representative will contact you promptly after your order has been placed. This may delay the shipping of your order.

Once payment is made there are no cancellations of order.

ORDER PROCESSING
4-week preorder and you will receive notification once your order is ready for delivery. Please note that CBNA is not responsible for any delays related to courier delays related to the pandemic.

PRODUCT AVAILABILITY
If any product is out of stock, it will be shown as “sold out” and you will not be able to purchase that product. However, you can send us an e-mail stating what item you want and your contact information. Once the product becomes available you will be sent a notification, we will not hold the product for clients, the notification is a courtesy to let you know your product is back in stock.

DISCLAIMER
CBNA reserves the right to cancel or change any program or product without notice at any time.

Complete Agreement
Except as expressly provided in a particular “legal notice” on the CBNA Sites, these Terms and Conditions constitute the entire agreement between you and CBNA with respect to the use of the CBNA Sites and Content.
